CACHE Terms and Conditions of Use – Detailed Summary

1. Agreement to Terms

By accessing or using CACHE's services—including its website, mobile application, or other platforms—you acknowledge that you have read, understood, and agree to be bound by these Terms and any other applicable policies (e.g., Privacy Policy, Seller Policies).

  • Age Restrictions: Users must be at least 13 years old to access the Services. If under the legal age of majority in your jurisdiction, you must have a parent or legal guardian’s consent to use the Services and agree to the Terms on your behalf.

  • Jurisdiction: These Terms are governed by the laws of the State of Minnesota, USA, without regard to conflict-of-law principles.


2. Binding Arbitration and Class Action Waiver

CACHE’s Terms include a mandatory arbitration clause and a waiver of class action rights:

  • Arbitration Requirement: Any dispute arising out of or relating to the Terms or use of the Services will be resolved through final and binding arbitration, unless you opt out within 30 days of account creation.

  • Class Action Waiver: Users agree not to bring or participate in class action lawsuits or class-wide arbitrations unless they have opted out in accordance with the stated procedures.

These provisions are intended to streamline dispute resolution and limit exposure to group litigation.


3. Changes to Terms

CACHE reserves the right to modify these Terms at any time without prior notice. Users are responsible for reviewing the Terms regularly.

  • Continued use of the Services following changes constitutes acceptance.

  • Significant updates may be posted prominently or sent via email.


4. Account Registration and Responsibilities

Users must provide accurate, current, and complete registration information.

  • Account Security: Users must maintain the confidentiality of their login credentials and are solely responsible for any activities under their account.

  • False Information or impersonation may lead to account suspension or legal liability.


5. Marketplace Functionality

CACHE acts as a neutral facilitator in connecting buyers and sellers. It is not a party to sales contracts unless CACHE itself is the seller.

  • Price Variability: Market dynamics may cause prices to exceed retail value.

  • No Warranty for Third-Party Sales: CACHE does not guarantee the legality, authenticity, or condition of items sold by third parties.


6. Fees, Taxes, and Payment Processing

  • Service Fees: CACHE may charge sellers and/or buyers a service fee, which will be disclosed before the transaction.

  • Tax Compliance: Users are responsible for paying any local, state, federal, or international taxes related to their transactions.

  • CACHE is not responsible for determining or remitting taxes on behalf of users unless legally obligated (e.g., under marketplace facilitator laws in certain states).


7. Authentication and Shipping

CACHE employs authentication processes to verify the legitimacy and condition of products sold on its platform.

  • Shipping Workflow:

    • Sellers ship items to CACHE’s facility for authentication.

    • Once verified, items are shipped to the buyer.

    • Expected transaction turnaround: 7–14 business days.

  • CACHE is not liable for delays caused by carriers, customs, or inaccurate shipping details.


8. Counterfeits and Fraud Prevention

CACHE has a zero-tolerance policy toward counterfeits and fraudulent activity.

  • Sellers found listing or shipping counterfeit goods may face:

    • Immediate account suspension or termination.

    • Fines of 15% or more of the transaction value.

    • Legal action and possible criminal liability.

  • Buyers must report suspected counterfeit items within three (3) calendar days of delivery. Failure to do so may waive rights to a refund.


9. Seller Obligations

  • Listings must accurately reflect the item’s condition, brand, size, color, and other specifications.

  • Sellers agree that all sales are final once a buyer matches with a listing.

  • Non-compliance—including late shipments, inaccurate listings, or canceled orders—may result in:

    • Fines

    • Loss of selling privileges

    • Damage to seller reputation metrics


10. Buyer Responsibilities

  • All sales are final upon authentication and delivery. Returns are generally not accepted unless an item is misrepresented or counterfeit.

  • International Buyers are responsible for any applicable customs duties or import taxes.

  • Chargebacks or failed payments may result in:

    • Account suspension

    • Additional fees or penalties

    • Collection activity or legal enforcement


11. Prohibited Activities

Users must not engage in the following while using CACHE:

  • Soliciting sales or communications outside the CACHE platform.

  • Abusing, threatening, or harassing other users or staff.

  • Uploading or distributing unlawful, obscene, defamatory, or misleading content.

  • Scraping, reverse-engineering, or attempting to access source code.

  • Introducing malware, overloading the system, or bypassing security mechanisms.

Violations may result in immediate termination of access, account deletion, and potential civil or criminal penalties.
